By accessing or using the Service, You agree to be bound by these Terms. If You do not agree to these Terms, You may not access or use the Service.

Words with capitalized initial letters have meanings defined below. These definitions apply whether the terms appear in singular or plural form.

Definitions

For the purposes of these Terms of Service:

• Application refers to Perform, the mobile application provided by the Company.
• Company (referred to as "We", "Us", or "Our") refers to PerformbyNourChaito, Center Tamara, Tallet El Khayyat, Beirut 0000, Lebanon.
• Service refers to the Application and any related services.
• You means the individual accessing or using the Service.

Acknowledgment

These Terms govern Your use of the Service and constitute a legally binding agreement between You and the Company.

You confirm that You are at least 13 years old. If You are under 18, You confirm that You have permission from a parent or legal guardian to use the Service.

Account Registration

To access certain features of the Service, You must create an account.

You agree to provide accurate, complete, and current information during registration and to keep Your account information updated.

You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions and Payments

Some features of the Service may require payment.

Payments may be processed through Apple In-App Purchases, Google Play Billing, or third-party payment providers such as Stripe. All billing and subscription management are handled by the respective provider in accordance with their terms.

Subscription fees, billing cycles, renewal terms, trial terms, and any promotional pricing will be disclosed at or before the time of purchase. By starting a subscription, submitting payment details, or confirming checkout, You expressly authorize the Company and the applicable payment provider to charge the disclosed subscription fee and any applicable taxes on a recurring basis until the subscription is canceled.

Subscriptions automatically renew at the end of each billing period unless canceled before the applicable renewal deadline. After You agree to an automatically renewing subscription, each renewal charge does not require separate month-to-month approval. If a free trial or promotional period is offered, You authorize the subscription to convert to a paid subscription at the disclosed price unless You cancel before the trial or promotional period ends.

You are responsible for canceling before the next renewal charge if You do not want the subscription to continue. Deleting the Application, not using the Service, or deleting Your account does not automatically cancel a subscription unless the applicable payment provider confirms cancellation.

We may send transactional renewal reminders by email or push notification. These reminders are a courtesy and do not change Your responsibility to cancel before renewal.

Cancellation

You may cancel Your subscription at any time through the same platform or payment provider used to subscribe. Stripe subscriptions may be managed through the account billing portal when available or by contacting Us. Apple subscriptions must be managed through Your Apple Account or App Store subscription settings. Google Play subscriptions must be managed through Google Play.

Cancellation stops future renewal charges. Unless otherwise required by applicable law or the payment provider's rules, cancellation does not automatically refund charges already paid, and Your access may continue until the end of the current paid billing period.

We will honor valid cancellation requests received through the available cancellation methods. If You have trouble canceling, contact Us using the details below and include the email address used for the subscription and the payment platform used.

Refund Policy

Except where required by applicable law, payment provider rules, or a written offer-specific refund policy, subscription fees, trial-conversion charges, and renewal charges are final and non-refundable. This includes situations where You forgot to cancel, did not use the Service, canceled after a renewal charge, or no longer want the subscription after the renewal date.

We may, in Our discretion, review refund requests for duplicate charges, billing errors, verified unauthorized transactions, technical issues that prevent access to paid features, or other exceptional circumstances. Granting a refund in one situation does not require Us to grant refunds in other situations.

If You purchased through Apple or Google Play, refund requests must be submitted to the applicable app marketplace and are decided under that provider's policies and applicable law. If You purchased through Stripe, contact Us to request review. An approved full refund immediately ends paid access.

Health and Fitness Disclaimer

The Service provides general fitness, exercise, and training information for educational purposes only.

The Service is not a medical service and does not provide medical advice, diagnosis, or treatment.

You acknowledge that participation in fitness activities involves inherent risks. You agree to consult a qualified medical professional before starting any exercise program, especially if You have pre-existing health conditions.

Use of the Service is at Your own risk. The Company is not responsible for injuries, health issues, or damages resulting from use of the Service.

User Conduct

You agree not to:

• Use the Service for unlawful purposes
• Share false, misleading, or harmful content
• Attempt to access other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, copy, or misuse the Service

We reserve the right to remove content or restrict access that violates these Terms.

Intellectual Property

All content, features, branding, designs, programs, and materials provided through the Service are owned by or licensed to the Company and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or exploit any part of the Service without prior written permission.

Termination

We may suspend or terminate Your access to the Service at any time, with or without notice, if You violate these Terms or misuse the Service.

You may terminate Your account at any time through the app or by contacting Us.

Upon termination, Your right to use the Service will immediately cease.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or special damages arising from Your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount You paid to use the Service in the twelve months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind.

We do not guarantee that the Service will be uninterrupted, error-free, or meet Your expectations.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Lebanon, without regard to conflict of law principles.

Dispute Resolution

In the event of a dispute, You agree to attempt to resolve the issue informally by contacting Us before pursuing legal action.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Lebanon, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the Service or on our website, and the "Last updated" date will be revised.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
